Aaron Dowling Photography Terms of Service (“Agreement”)

These terms and conditions relate to the photography workshops and tours organised by Aaron Dowling Photography, and run by Aaron Dowling and Tiffany Dowling, the workshop leaders. The itinerary is subject to change to accommodate local conditions and opportunities.

PRICE:

The price includes photographic tuition, workshops, all ground transportation from Banff and Canmore. Pricing does not include entrance fees to the national parks.

RESERVATIONS:

Bookings are made through the contact form on the Half Day and Full Day Photography Tour Pages. This tour is limited to a maximum of four (4) persons plus instructors. Trip spaces will be confirmed in order of receipt and upon payment.

PAYMENT:

To confirm your trip place, full payment is required at time of confirmation and may be made by Direct Deposit or through our Paypal Account (accepting all major credit cards, a Paypal account is not required). Once your reservation has been confirmed, payment of the trip fee balance is required in full. We regret that personal or bank cheques are not accepted. We reserve the right to cancel your booking if payment is not received when due, wherein the Cancellations and Refunds clause, listed below, shall come into effect.

CANCELLATIONS & REFUNDS

Should you wish to cancel your booking, you must advise us in writing (email is fine). If the Tour is cancelled by Aaron Dowling Photography for any reason a full refund of any payments made will be given. If you decide to cancel your attendance on the photography tour for any reason within 7 days of the tour departure no refund will be given. If you cancel outside of 7 days, 70% of your booking fee will be refunded.

In the event the tour is cancelled due to weather warnings from Environment Canada, we will work with you to re-schedule, if this is not possible a full refund will be offered. Tours will not be cancelled due to adverse weather conditions.

HEALTH REQUIREMENTS:

The tour is designed to be suitable for people of all ages in good health and moderate fitness. While activities are not strenuous, on some trips we will be walking on hiking tracks in wilderness areas, including alpine regions, which involve uphill walks and uneven ground under possible cold/icy conditions. Although it’s not possible to predict weather in mountainous regions, the mornings and evening can be quite cool, this is highly dependant on the time of year. It will be necessary to carry your own camera equipment, extra clothing, food and water for these activities. Should you have any concerns about your own capabilities and/or fitness in relation to a particular trip, please contact us to discuss this before sending your reservation form. You are required to disclose any medical or physical condition that you have which could create a risk for you or any other participants. We assume no responsibility for medical care nor guarantee to meet any special dietary requirements.

Being in the Canadian Wilderness there is a possibility of encountering wildlife such as: Bears, Cougars, Moose, Elk and other wild animals. Aaron Dowling Photography will give a briefing at the beginning of the tour and reminders throughout on what do to prevent encounters or in the event of encountering wildlife while in the field, although the likelihood of such an encounter is low.

INSURANCE:

Personal insurance is mandatory for all participants and their equipment and personal belongings as no insurance is included in the trip fees. Acquisition of travel insurance is your sole responsibility.

RESPONSIBILITY:

The responsibility of Aaron Dowling Photography is strictly limited. As a workshop operator, Aaron Dowling Photography may organise, promote, and sell programs consisting of services that it purchases from various suppliers. Aaron Dowling Photography does not own or operate any of these suppliers and as such is not responsible for any negligent or wilful act or failure or omission of any supplier. By taking part in the workshop, you agree that Aaron Dowling Photography shall not be liable for the above failings. Aaron Dowling Photography cannot accept responsibility for losses or extra expenses caused by, but not limited to, delay or changes in any transportation services, weather, illness, injury, strike, quarantine or other causes. All such losses or expenses will be the sole responsibility of the participant. Aaron Dowling Photography reserves the right to cancel any workshop prior to commencement, whereupon paid funds will be refunded in full, but is not liable for any other trip preparation expenses such as, but not limited to, air ticket penalties, visa fees and medical treatments. Where weather conditions or forces of nature restrict or prohibit workshop activities, it reserves the right to alter the trip program and substitute alternative activities. Prior to commencement of any workshop the Acceptance of these Terms & Conditions at the time of reservation is a term of sale. The Acceptance of the Terms & Conditions must be agreed to by each participant prior to the commencement of the workshop, and the responsibility to inform additional guests is the responsibility of the person making the reservation. No alterations to the Terms and Conditions will be accepted. A participants attendance in a workshop confirms their acceptance of all parts of these Terms and Conditions. These Terms and Conditions, shall be governed in all respects by and interpreted in accordance with the law within Alberta, Canada.

There may be hazards on this workshop and you must follow the instructions of your workshop leaders. Please let your workshop leaders know immediately if you identify hazards. Aaron Dowling Photography reserves the right to withdraw any person who in its opinion is likely to endanger themselves or others. Aaron Dowling Photography also reserves the right to cancel the workshop if hazards could compromise the safety of any person. Aaron Dowling Photography assumes no responsibility for any personal loss, damage or injury.

Please advise us if you have any physical conditions that may affect your safety or enjoyment of your workshop, e.g. asthma, allergies, heart conditions, epilepsy or pregnancy. If you have any food allergies, please give details for catering purposes. We will do our best to cater for your needs.

In checking that you agree with the Terms and Conditions, you acknowledge that you have read and understood the above safety terms and risks.

You assume responsibly for yourself and your possessions during the workshop.

Any participants under the age of 18 must be accompanied by a responsible adult.
